General Terms and Conditions of Sale for the Pikeur Online Shop

I Scope

These General Terms and Conditions of Sale apply to orders placed in the Pikeur online shop by consumers and business customers. A consumer is any natural person who enters into a legal transaction predominantly for private purposes. A business customer is a natural or legal person or a partnership with legal capacity that, when entering into the contract, acts in the course of its commercial or independent professional activities.

Any differing terms and conditions of the customer shall apply only if we have expressly agreed to their application.

II Contracting Party and Formation of the Contract

The contract of sale is concluded with Pikeur Reitmoden Brinkmann GmbH & Co. KG, Esch 19, 33824 Werther.

The presentation of products in the online shop does not constitute a binding offer, but an invitation to place an order.

You may initially add products to your shopping basket without obligation and amend your entries before submitting your order using the correction tools provided during the ordering process. By clicking the order button, you submit a binding offer to purchase the goods in your shopping basket.

We will acknowledge receipt of your order promptly by email. This acknowledgement does not constitute acceptance of your offer. The contract is concluded when we accept your offer by sending a separate order confirmation or dispatching the goods. Acceptance will take place no later than five days after receipt of the order. An automatic payment authorisation or acknowledgement of receipt alone does not constitute acceptance unless we expressly state otherwise.

III Contract Language and Contract Terms

The language available for concluding the contract is German. We will send you the contract terms, including these General Terms and Conditions, and the order details in text form.

IV Right of Withdrawal

Consumers have a statutory right of withdrawal. Details are set out in the separate withdrawal instructions, including information on the electronic withdrawal function.

V Prices, Payment Due Dates and Payment

The prices displayed in the shop at the time of the order shall apply. Prices for consumers include statutory VAT. The shipping costs shown in the shop are payable in addition. Delivery restrictions and accepted payment methods will be displayed no later than at the start of the ordering process.

The purchase price becomes due when the contract is concluded, unless a different payment due date is shown at checkout for the selected payment method. The available payment methods and their specific terms are displayed at checkout. For payment methods processed through Mollie, the technical payment processing is handled by Mollie B.V. and, depending on the selection, the relevant payment provider. If PayPal or Klarna is selected, the terms and conditions of the respective provider, available at checkout, shall also apply.

VI Retention of Title

The goods remain our property until the purchase price has been paid in full. For business customers, we retain title to the goods until all claims arising from the ongoing business relationship have been settled. Business customers may resell goods subject to retention of title in the ordinary course of business; they hereby assign to us the resulting receivables up to the amount of the invoice. We accept this assignment. The business customer remains authorised to collect the receivables as long as it duly fulfils its payment obligations.

VII Set-off and Rights of Retention

Consumers may only set off counterclaims that are undisputed, have been established by a final and binding judgment, or are ready for a judicial decision. This restriction does not apply to claims arising from the same contractual relationship. Consumers may exercise a right of retention insofar as it is based on the same contractual relationship. Business customers may only set off claims that are undisputed or have been established by a final and binding judgment.

VIII Statutory Rights in Respect of Defects and Guarantees

Consumers have the statutory rights in respect of defects.

For business customers, the limitation period for claims in respect of defects is one year from the transfer of risk. This does not apply to claims for damages, defects fraudulently concealed, guarantees given, claims under the German Product Liability Act or rights of recourse under sections 445a and 478 of the German Civil Code (BGB). When providing supplementary performance to business customers, we may choose between remedying the defect and supplying replacement goods. Special statutory provisions governing recourse remain unaffected.

Where applicable, information on any additional guarantee and its terms can be found with the relevant product. A guarantee does not restrict the statutory rights in respect of defects.

IX Liability

Our liability is unlimited for loss or damage arising from injury to life, body or health, for loss or damage caused intentionally or by gross negligence, in cases of fraudulent concealment of a defect, within the scope of a guarantee given, and under the German Product Liability Act.

In the event of a breach of a material contractual obligation caused by ordinary negligence, our liability is limited to the foreseeable loss or damage typical of the contract at the time it was concluded. Material contractual obligations are obligations whose fulfilment is essential for the proper performance of the contract and on whose fulfilment the other contracting party may ordinarily rely. In all other cases, liability for loss or damage caused by ordinary negligence is excluded.

The above liability provisions also apply for the benefit of our legal representatives and persons engaged to perform our contractual obligations.

X Data Protection

Information on the processing of personal data can be found in our privacy policy, which is available in the online shop.

XI Applicable Law and Jurisdiction

German law shall apply, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.

If the customer is a merchant within the meaning of German commercial law, a legal person under public law or a special fund under public law, our registered place of business shall be the exclusive place of jurisdiction for all disputes arising from the contractual relationship.

XII Consumer Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body.
